Terms of Service

1. Agreement to Terms

By booking our services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Rainbow Kreativ provides professional videography, photography, and related creative services as described in our service packages. The specific deliverables, timeline, and pricing will be outlined in your individual contract or booking confirmation.

3. Booking & Deposits

• A 30% non-refundable deposit is required to secure your booking date.
• The second payment of 40% is due 4 weeks before your event date.
• The final balance of 30% is due on the event day or upon delivery of final files.
• Your date is not confirmed until the deposit is received and a signed contract is returned.

4. Cancellation Policy

• More than 90 days before event: Deposit is non-refundable but may be transferred to a new date within 12 months.
• 60-90 days before event: 50% of total package price is due.
• 30-60 days before event: 75% of total package price is due.
• Less than 30 days: Full payment is due regardless of cancellation.
• If we cancel due to unforeseen circumstances, you will receive a full refund or the option to reschedule.

5. Rescheduling

You may reschedule your event date once, subject to our availability, with at least 60 days notice. Rescheduling within 60 days of the original date may incur a rescheduling fee of €200. The new date must be within 12 months of the original booking.

6. Client Responsibilities

• Provide accurate event details and timeline
• Ensure we have adequate access to all areas for filming
• Obtain necessary permits for venue filming if required
• Provide a vendor meal for coverage exceeding 6 hours
• Inform us of any restrictions or special requirements in advance
• Designate a point of contact for the event day

7. Deliverables & Timeline

• Delivery timelines vary by package (4-12 weeks as specified)
• Social media teasers (if included) are typically delivered within 1 week
• One round of revisions is included; additional revisions are €100 each
• Final files are delivered via private online gallery with download access
• USB delivery is included in select packages

8. Copyright & Usage Rights

• Rainbow Kreativ retains copyright of all photos and videos produced.
• Clients receive a perpetual, non-exclusive license to use the content for personal, non-commercial purposes.
• We reserve the right to use content in our portfolio, website, and marketing with your written consent.
• Commercial use of footage requires separate licensing arrangements.
• You may not sell, license, or distribute the content to third parties.

9. Limitations of Liability

• We carry professional liability insurance and equipment insurance.
• In the unlikely event of equipment failure or data loss, our liability is limited to a refund of fees paid.
• We are not liable for events beyond our control (weather, venue restrictions, guest behavior, etc.).
• We cannot guarantee specific shots if conditions prevent safe or permitted filming.

10. Backup Videographer

In the rare event that the assigned videographer cannot attend (illness, emergency), we will provide a qualified replacement of equal skill level. If no suitable replacement is available, you will receive a full refund.

11. Weather & Force Majeure

We will film in most weather conditions. However, safety takes priority. If conditions are dangerous (lightning, severe storms), we will temporarily pause until safe. For outdoor events, we recommend having a backup plan. Force majeure events (natural disasters, government restrictions, etc.) allow for rescheduling without penalty.

12. Music Licensing

All music used in your films is properly licensed through our music licensing agreements. Specific song requests outside our library may incur additional licensing fees. We cannot use copyrighted music without proper licensing.

13. Privacy & Confidentiality

We respect your privacy. Personal information and event details are kept confidential. We will not share your content publicly without your explicit written consent. See our Privacy Policy for full details.

14. Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiation. If unresolved, disputes will be subject to mediation before any legal action. The laws of Spain shall govern these terms.

15. Changes to Terms

We may update these terms from time to time. Changes will not affect existing contracts. The current version will always be available on our website.
